A Payment Dispute Between a Chinese Enterprise and an Enterprise in a Central Asian country

In 2017, a large Chinese enterprise exported bulky mechanical equipments to an enterprise in a Central Asian country, involving an amount of more than US $40 million. However, no subsequent payment was received and attempts to contact the enterprise failed. After a comprehensive review of the relevant information in the case, ICDPASO considered that, although the contractual relationship in this case was relatively simple and the rights and obligations were clear, with regard to the complex political factors in the Middle East, it was difficult to arbitrate under the contractual dispute settlement clause which stipulated the arbitration institution located in the country of purchaser and the language of arbitration was Russian. In addition, the case was in a critical period of global economic downturn, the outbreak of COViD-19, and the bilateral relations are delicate. Attention also needed to be paid to the external impact and catalytic role of political and diplomatic approaches, civil business associations, etc.
